PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE OR ENROLLING IN THE PROGRAM. By accessing or using this website, enrolling in the Membership, or using any related services, you acknowledge and agree to be bound by the following terms and conditions. If you do not agree to these Terms of Use, you must not access or use the website, the Membership, or the services.

This agreement governs your access to and use of this website and all services and content provided by UnCreative Capital LLC, including www.thecreative-trader.com and The Creative Trader live trading community and membership (collectively, the "Site," and the live program, the "Membership" or the "Program").

1. Description of the Program

The Creative Trader Membership is a recurring-subscription, educational live trading community. The Membership may include, without limitation: live trading sessions and screen-shares; community access (including via Discord or other platforms); educational content, lessons, and recordings; access to proprietary tools or indicators; and related materials. Access is provided on a subscription basis for the duration of an active, paid Membership and is subject to these Terms.

The specific features included in the Membership may change, be added, or be removed at any time at our sole discretion. We do not guarantee the continued availability of any particular session, feature, tool, host, or community member.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) and legally able to enter into a binding contract to use the Site or enroll in the Membership. By enrolling, you represent and warrant that you meet these requirements.

3. Intellectual Property Rights & Limited License

All content and materials on the Site and within the Membership (including live sessions, recordings, videos, graphics, images, audio, code, indicators, documentation, and community materials) are the intellectual property of UnCreative Capital LLC or its third-party licensors. You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Membership solely for your own personal, non-commercial, educational purposes for the duration of your active Membership.

Unauthorized use, reproduction, redistribution, public display, resale, or commercial exploitation of any content is strictly prohibited and may violate copyright, trademark, or other laws. This license terminates automatically upon cancellation, non-payment, or termination of your Membership.

4. Copyright Notice

All content is protected by copyright laws unless otherwise noted. Any unauthorized use or reproduction may result in legal action.

5. Trademarks and Proprietary Rights

All trademarks, service marks, logos, and names are either owned by or licensed to UnCreative Capital LLC, including but not limited to "The Creative Trader" and the Confirmation Model. Unauthorized use is strictly prohibited. If you believe your intellectual property has been infringed, contact us at [email protected].

6. Live Content, Community Conduct & Restrictions

The Membership includes access to live sessions and a community environment. By participating, you agree that you will not:

record, screen-capture, screenshot, stream, transcribe, or otherwise reproduce any live session, call, or proprietary material;

share, repost, distribute, or resell any login credentials, content, recordings, signals, screenshots, or community material to any non-member or third party;

redistribute, republish, or commercialize any indicator, tool, or methodology provided through the Membership;

harass, threaten, defame, spam, solicit, or harm other members or staff, or disrupt sessions or the community; or

use the Membership to provide your own trading advisory, signal, or money-management services to others.

We may remove, suspend, or permanently ban any member who violates these rules at our sole discretion and without refund. We reserve the right to moderate, edit, or remove any user content and to restrict access to any session, channel, or feature at any time.

7. Accuracy of Content

We make no warranties as to the accuracy, completeness, or currency of any content, including content presented during live sessions. Content may be changed or removed without notice. Live commentary, analysis, and trades are presented in real time, may contain errors, and should not be relied upon as fact.

8. Electronic Communications

By registering, enrolling, or using this Site, you consent to receive electronic communications, including emails, in-app messages, and notifications related to your account, billing, updates, policies, services, and promotional content. You may opt out of promotional communications at any time; transactional and account communications are required for the operation of your Membership.

9. Earnings, Results & "Not Financial Advice" Disclaimer

The Creative Trader Membership is provided strictly for educational and informational purposes.

UnCreative Capital LLC is not a registered investment adviser, broker-dealer, commodity trading advisor, or financial planner, and does not provide financial, investment, trading, tax, or legal advice. Nothing in the Membership constitutes a recommendation, solicitation, or offer to buy or sell any security, futures contract, or other financial instrument.

Live trades, setups, analysis, and commentary shown during sessions are demonstrations for educational purposes only. They are NOT trade signals, recommendations, or instructions to enter, exit, or copy any trade. Any decision you make to trade is your own independent decision, made at your own risk. You should not place any trade based on anything shown or said in the Membership without conducting your own analysis and, where appropriate, consulting a licensed professional.

Any references to funding, income, payouts, account passes, or performance—whether shown by us or by other members—are exceptional results, are not verified by us, and are not representative of typical user experience. We make no guarantees, express or implied, regarding your ability to earn money, secure or keep funding, pass any evaluation, or achieve any outcome. You are solely responsible for your financial decisions and results. Participation is entirely at your own risk.

10. Assumption of Trading Risk

Trading futures, derivatives, and other leveraged instruments involves substantial risk of loss and is not suitable for every investor. You acknowledge that you may lose some or all of your capital, and potentially more than your initial deposit. You assume full responsibility for, and all risk associated with, any trading activity you undertake. UnCreative Capital LLC is not responsible for any trading losses you incur.

11. Affiliate & Sponsorship Disclosure

We may receive compensation, commissions, or other benefits when you sign up for, fund, or use third-party services (including proprietary trading firms) through links, codes, or referrals we provide. Any such relationship does not increase your cost and does not constitute an endorsement that any third-party service is suitable for you. You are responsible for independently evaluating any third-party service and reviewing its terms.

12. Subscription, Billing & Automatic Renewal

The Membership is a recurring subscription. By enrolling, you authorize us and our payment processor to charge your designated payment method on a recurring basis according to the plan you select.

7-day free trial: A valid payment method is required to start your 7-day free trial. Unless you cancel before the end of the 7-day trial period, your Membership will automatically convert to a paid subscription and your payment method will be charged $98.00 (USD) for your first monthly billing period.

Recurring charges: After the trial, your Membership is billed at $98.00 (USD) per month and will automatically renew each month at the then-current rate. Your payment method will be charged automatically at the start of each monthly billing period until you cancel.

Price changes: We may change Membership pricing. We will provide notice of any price change as required by applicable law, and the change will apply to billing periods beginning after the notice.

Failed payments: If a charge fails, we may suspend or terminate your access until payment is resolved. You remain responsible for amounts owed.

Summary of charges: 7-day free trial → then $98.00/month, automatically renewing, until cancelled. You can cancel anytime, yourself, from your Whop portal (see Section 13).

13. Cancellation & Refund Policy

You may cancel your Membership at any time through your Whop account portal (the same portal you used to subscribe), which lets you cancel yourself without contacting us. If you need help, you may also email [email protected]. Cancellation stops future renewal charges and takes effect at the end of your current billing period. You will retain access to the Membership through the end of the monthly period you have already paid for. We do not provide prorated or partial refunds for the unused portion of any monthly billing period.

If you cancel during your 7-day free trial, you will not be charged and your access will end at the close of the trial period.

Refunds. Because the Membership delivers live, time-sensitive services and access that are consumed in real time, all payments are non-refundable except as expressly required by applicable law. Canceling a Membership prevents future charges but does not retroactively refund charges already incurred for the current or prior billing periods.

Removal or banning of a member for violation of these Terms (including Section 6) does not entitle that member to any refund.

The Company may, in its sole discretion, issue a refund or credit in individual cases, but is not obligated to do so. Customers acknowledge and agree that this policy is the exclusive remedy available regarding payments, and that no other warranties, promises, or guarantees of refunds apply. You waive any right to pursue additional claims, damages, or remedies related to payments made for the Membership, except as required by law.

Because your 7-day free trial gives you a full opportunity to evaluate the Membership at no charge before any payment is taken, charges incurred after the trial are non-refundable as stated above.

14. User Submissions

Any ideas, feedback, suggestions, or content you submit to the Site or community (excluding your personal account information) may be used by us without compensation or obligation. We reserve the right to use, display, and reproduce such submissions for any purpose.

15. Security and Access

While we strive to protect your data, we cannot and do not guarantee complete security. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You accept all risks associated with using the Site, including potential unauthorized access. You agree not to share your account access with any other person.

16. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, available at https://www.thecreative-trader.com/privacy. Continued use constitutes acceptance of our data collection and processing practices.

17. Third-Party Disclaimers

We are not responsible for any errors, delays, or failures caused by third-party services, including payment providers (e.g., Stripe), hosting and communication platforms (e.g., Discord), proprietary trading firms, brokers, or data providers. Disputes or malfunctions involving third parties must be resolved with those third parties directly. Your use of any third-party service is governed by that party's own terms.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UnCreative Capital LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TRADING LOSSES, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SITE, THE MEMBERSHIP, OR ANY ASSOCIATED SERVICES, OR TO ANY TRADING DECISION YOU MAKE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO US FOR THE MEMBERSHIP IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT), ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

19. Indemnification

You agree to indemnify, defend, and hold harmless UnCreative Capital LLC, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in any way connected with: (a) your use of the Site, the Membership, or services; (b) your violation of these Terms of Use; (c) your violation of any law or the rights of any third party; (d) any content you submit or share through the Site or community; or (e) any trading or financial decision you make. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate fully with us.

20. Termination

We may suspend or terminate your access to the Site or Membership at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your license to use the content immediately ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

21. Governing Law & Jurisdiction

This agreement shall be governed by and interpreted in accordance with the laws of the State of Illinois, without regard to its conflict-of-laws principles. You irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Chicago, Illinois, for all legal proceedings arising under or related to these Terms.

22. Revisions

We reserve the right to change these Terms of Use at any time. It is your responsibility to review them periodically. When changes are made, the "Last Updated" date at the top of this page will be revised to reflect the effective date of the update. Your continued use of the Site or Membership after any update constitutes your acceptance of the revised Terms. Updates apply prospectively and govern all purchases and renewals made after the effective date.
