6. SMS and Text Messaging Terms

UnCreative Capital LLC, which operates The Creative Trader, may offer SMS or MMS messaging programs for users who voluntarily provide their mobile telephone number and affirmatively consent to receive the applicable category of messages.

Depending on the consent you provide, text messages may include non-marketing communications such as registration confirmations, reminders, scheduling information, account or membership notifications, customer support communications, onboarding information, purchase or payment-related information, or other service-related messages.

If you separately consent to receive promotional communications, text messages may also include promotional offers, discounts, program announcements, educational content updates, service updates, re-engagement messages, or other promotional communications described at the time you opt in.

SMS communications are sent only in accordance with the consent you provide. Consent to receive SMS or MMS messages is voluntary and is not a condition of purchasing any product or service.

Opting Out of SMS

You can cancel the SMS service at any time. Just text STOP to the phone number from which you receive our text messages.

After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive the applicable SMS messages from us.

If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again in accordance with your new consent.

11. Earnings and Results Disclaimer

We make no guarantees, express or implied, regarding your ability to earn money, become profitable, secure funding, pass an evaluation, obtain a payout, or achieve any other result.

12. Refund Policy – 7-Day Satisfaction Guarantee

Unless a specific product or offer expressly states otherwise at the time of purchase, the Company offers a 7-Day Satisfaction Guarantee for The Creative Trader course.

Customers may request a full refund within seven (7) days of purchase if they are not satisfied, provided that less than fifty percent (50%) of the applicable course content has been accessed or completed.

Course progress is determined using records available through the applicable learning management system and may include videos, modules, lessons, downloads, and related course materials accessed or completed.

If fifty percent (50%) or more of the applicable course content has been accessed or completed, no refund will be issued under the 7-Day Satisfaction Guarantee.

No refund will be issued under this guarantee after seven (7) days from the date of purchase.

This policy is intended to provide customers with a reasonable opportunity to evaluate the applicable program while protecting the Company against misuse of the refund policy.

Products, memberships, subscriptions, mentorship programs, live services, indicators, digital products, or other offerings may have separate refund, cancellation, or payment terms disclosed at checkout or in an applicable agreement. Where separate written terms apply to a specific purchase, those terms will govern that purchase.

13. Recurring Subscriptions and Memberships

Certain Services may be offered on a recurring subscription or membership basis.

If you purchase a recurring subscription, you authorize the applicable recurring charges disclosed at the time of purchase until you cancel in accordance with the cancellation terms presented for that Service.

Cancellation of a recurring subscription generally stops future renewal charges but does not automatically entitle you to a refund of charges already processed, except where required by law or expressly stated in the applicable offer terms.

14. Third-Party Services

The Site and Services may rely on or integrate with third-party platforms, payment systems, hosting services, communications tools, community platforms, software providers, or other services.

We are not responsible for outages, errors, delays, interruptions, data loss, or other failures caused by systems or services outside our reasonable control.

Your use of a third-party service may also be subject to that third party's separate terms and policies.

Termination or suspension does not eliminate any payment obligations or other rights and obligations that accrued before termination.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, SERVICES, CONTENT, PROGRAMS, AND MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

UNCREATIVE CAPITAL LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNCREATIVE CAPITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TRADING LOSSES, LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR LOSS OF OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE, SERVICES, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO UNCREATIVE CAPITAL LLC FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

19. Indemnification

You agree, to the extent permitted by law, to indemnify, defend, and hold harmless UnCreative Capital LLC and its owners, officers, directors, employees, contractors, agents, and licensors from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

Your misuse of the Site or Services;
Your violation of these Terms;
Your violation of applicable law;
Your violation of the rights of another person or entity; or
Content you submit or make available through the Services.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification, in which case you agree to cooperate reasonably with our defense.

20. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles.

To the extent permitted by law, you agree that any legal proceeding arising out of or relating to these Terms, the Site, or Services shall be brought in the applicable state or federal courts located in Chicago, Illinois, and you consent to the jurisdiction of those courts.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

22. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

These Terms, together with our Privacy Policy and any additional terms expressly presented in connection with a specific product, Service, subscription, membership, mentorship, or purchase, constitute the agreement between you and UnCreative Capital LLC concerning your use of the applicable Services.

We may revise these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other operational needs.
